By registering for an account, accessing the API, or utilizing the Prometheus Quant Engine ("The Engine"), you agree to be bound by these Terms of Service. If you do not agree to all terms and conditions, you are expressly prohibited from using the platform.
PROMETHEUS IS NOT A REGISTERED BROKER-DEALER, INVESTMENT ADVISOR, OR FIDUCIARY. THE PLATFORM PROVIDES PURELY MATHEMATICAL AND COMPUTATIONAL APPROXIMATIONS BASED ON STOCHASTIC CALCULUS. IT DOES NOT CONSTITUTE FINANCIAL, TRADING, OR INVESTMENT ADVICE.
UNDER NO CIRCUMSTANCES SHALL PROMETHEUS, ITS FOUNDERS, OR ITS AFFILIATES BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECULATIVE DAMAGES, INCLUDING BUT NOT LIMITED TO FINANCIAL LOSSES, TRADING DEFICITS, REVENUE DEPRIVATION, OR BUSINESS INTERRUPTION RESULTING FROM THE USE, INABILITY TO USE, OR MATHEMATICAL INACCURACIES OF THE ENGINE. ALL TRADING DECISIONS MADE USING OUR OUTPUTS ARE MADE AT YOUR SOLE AND ABSOLUTE RISK.
The Monte Carlo simulations and theoretical option pricing models provided are based on complex algorithmic approximations. We do not warrant that the results will be completely error-free, uninterrupted, or perfectly convergent. The Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
All algorithms, distributed computing architectures, and software binaries powering the Engine are the exclusive intellectual property of Prometheus. You are strictly prohibited from attempting to decompile, reverse engineer, extract the mathematical models, or use programmatic probing to infer the proprietary stochastic calculus methodologies utilized by our backend cluster. Any such attempt will result in immediate termination and potential legal action for intellectual property infringement.
Prometheus acts as a high-performance computation layer, not a data warehousing solution. We automatically purge simulation matrices, results, and logs older than 30 days for Standard accounts. You are solely responsible for exporting and persisting your calculation data to your own infrastructure.
You agree not to circumvent, bypass, or exploit the platform's Rate Limiting infrastructure. Prometheus reserves the right to throttle, suspend, or permanently terminate your programmatic access (X-API-Key) without prior notice if we detect abusive, malicious, or overwhelmingly negligent request volumes that threaten the stability of the HPC cluster.
For users residing in the European Economic Area (EEA) or the UK: By purchasing Compute Credits, you expressly consent to the immediate provisioning of digital content. You acknowledge that by accessing the Engine and utilizing the API, you lose your right of withdrawal (14-day refund period). All sales processed by our Merchant of Record are final once credits are allocated to your ledger.
The Service is subject to United States and international export control and sanctions laws. By accessing Prometheus, you represent and warrant that you are not located in, under the control of, or a national/resident of any embargoed country (including but not limited to Cuba, Iran, North Korea, Syria, or the Crimea/Donbas regions) or on any U.S. Government list of prohibited or restricted parties.
Prometheus is a Business-to-Developer (B2D) and institutional platform. It is not intended for use by minors. You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and execute programmatic simulations.
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined by private, binding arbitration in the State of Mexico, Mexico, rather than in public court. YOU AND PROMETHEUS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate another person's claims with your claims.
These Terms shall be governed and construed exclusively in accordance with the laws of the United Mexican States, without regard to its conflict of law provisions.
You agree to indemnify, defend, and hold harmless Prometheus Quant Engine, its developers, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the API, or your infringement of any intellectual property or other rights of any third party.
If any provision of these Terms is held to be unenforceable, invalid, or illegal by a court of competent jurisdiction, such provision shall be modified to the extent necessary to render it enforceable while maintaining its original intent. The remaining provisions of these Terms shall remain in full force and effect without being impaired or invalidated in any way.
